1. Warranty: “New” parts carry a warranty for 12 months or 20,000km from the date of purchase whichever comes first, subject to the terms contained in policy and procedures manual.
2. Used / Secondhand parts carry a 3 month or 5000km warranty from purchase date.
This warranty is in addition to the guarantees provided by the Consumer Guarantees Act 1993.
3. If the consumer acquires or holds himself or herself out as acquiring the goods and services for the purposes of a business, the guarantees contained in the Consumer Guarantees Act 1993 will not apply to the goods supplied pursuant to this agreement.
4. No condition, warranty or promise, express or implied, other than those provided by the Consumer Guarantees Act 1993 applies to this agreement.
5. Expect as provided in the Consumer Guarantees Act 1993,Motorway Limited shall not be liable for any loss of any kind whatsoever suffered by the customer as a result of any breach of any of the Motorway Limited’s obligations under this agreement including any cancellation of this agreement or any negligence on the part of the Motorway Limited its servants, agents or contractors nor shall the Motorway Limited be liable for any loss, damage or injury caused to the customer’s servants, agents, contractors, customers, visitors, tenants, trespassers or other persons. The customer will indemnify the Motorway Limited against any claim by such persons.
6. Notwithstanding anything else in this agreement, the liability of the Motorway Limited arising from breach of any of Motorway Limited’s obligations under the agreement, from any cancellation of this agreement or from any negligence on the Motorway Limited’s part, its servants, agents or contractor (but not for any liability under the Consumer Guarantees Act 1993) will be limited to damages which will not exceed the contract price.
7. Notwithstanding the granting of credit, the passing risk, the giving of possession or delivery, full property (being both legal and equitable title) in the goods will remain with the Motorway Limited until the Customer has paid the Motorway Limited for the goods in full. Until property in the goods has passed the Customer will hold goods as the fiduciary agent and bailee of the Motorway Limited and will keep the goods separate and identifiable as the property of Motorway Limited and will preserve the goods in their present form.
Credit Returns
Credits sought for returned goods shall be at the discretion of Motorway Limited and subject to the following conditions:
1. Goods must be returned within 14 days of the invoice date and be accompanied by a credit return stating the reasons for the return.
2. Goods must be in an unused, unmarked and saleable condition. Goods must be in the original packaging.
3. Credit returns will be subject to a 20% surcharge.
4. Goods procured overseas and electrical goods are not returnable.
5. Exchange parts must be cleaned and returned in original box to receive a credit for surcharge.
